Overview

This website is operated by Atlanta Gold & Silver, LLC, DBA Alex Lexington (“we,” “us,” or “our”). Throughout the site, the terms “Service” and “Site” refer to https://alexlexington.com and all related information, tools, and services. By visiting our Site and/or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including all policies and notices referenced herein. If you do not agree to these Terms, do not access or use our Service.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

Section 1 – Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction (or have parental/guardian consent). You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including copyright laws). You must not transmit worms, viruses, or any destructive code. A breach of these Terms will result in immediate termination of your access and services.

Section 2 – General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that content (other than credit card information) may be transferred unencrypted and may involve transmissions over various networks. Credit card data is always encrypted. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission. Headings in this agreement are for convenience only and do not affect these Terms.

Section 3 – Accounts; KYC/AML; CIP

  • Account Registration: You may be required to create an account. You agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activity under your account.
  • Anti-Money Laundering (AML): We maintain an AML Program compliant with the Bank Secrecy Act, USA PATRIOT Act, FinCEN regulations, and FINRA Rule 3310. Our risk-based controls are designed to prevent money laundering, terrorist financing, and related illicit activity. We may cancel or refuse transactions deemed suspicious and file Suspicious Activity Reports as required.
  • Customer Identification Program (CIP): In accordance with our CIP Policy, we collect and verify:
    • Full legal name
    • Street address
    • Date of birth
    • Taxpayer ID (SSN/EIN) or foreign equivalent
    • Phone and email
    • Entity documentation (e.g., Articles of Incorporation, Business License)
    We use documentary and non-documentary methods to verify identity. Transactions where identity cannot be verified will be refused.

Section 4 – Accuracy, Completeness & Timeliness of Information

We are not responsible if information on this Site is inaccurate, incomplete, or outdated. Material is provided for general information only and should not be relied upon without consulting primary sources. Historical information is provided for reference only. We reserve the right to modify Site content at any time, though we have no obligation to update it. It is your responsibility to monitor changes.

Section 5 – Modifications to the Service & Prices

Prices for our products are subject to change without notice. We may modify or discontinue the Service (or any part) at any time without liability to you or third parties.

Section 6 – Products or Services

Certain products/services may be available exclusively online and in limited quantities. All are subject to our Return & Refund Policy. We have made every effort to display product colors and images accurately but cannot guarantee your monitor. We reserve the right to limit sales or quantities and to discontinue products at any time without notice. Any descriptions or pricing errors may be corrected and orders canceled.

Section 7 – Accuracy of Billing & Account Information

We may refuse or cancel any order at our discretion. We may limit quantities per person, household, or order. If we make changes or cancel, we will attempt to notify you via the contact information provided. You agree to provide current, complete, and accurate purchase and account information and to update it promptly.

Section 8 – Optional Tools

We may offer access to third-party tools (“Tools”) over which we have no control. Your use of these Tools is at your own risk and subject to the third party’s terms. Any new features or tools will be subject to these Terms.

Section 9 – Third-Party Links

Our Service may contain links to third-party websites. We are not responsible for their content or practices and do not endorse them. You engage with third-party sites at your own risk; direct any complaints to the third party.

Section 10 – User Comments, Feedback & Other Submissions

By submitting comments or other content, you grant us a perpetual, royalty-free, transferable license to use, reproduce, modify, distribute, and display such content. You represent that you have all rights to your submissions and that they do not violate any third-party rights.

Your submission of personal data through the Service is governed by our Privacy Policy.

Section 12 – Errors, Inaccuracies & Omissions

Occasionally there may be information on our Site or in the Service that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct these and to change or update information at any time without prior notice.

You agree to indemnify and hold Atlanta Gold & Silver, LLC, its affiliates, officers, and employees harmless from any claim or demand, including attorneys’ fees, arising out of your breach of these Terms or violation of any law or rights of a third party.

If any provision of these Terms is held unlawful or unenforceable, that provision will be severed, and the remainder will remain in full force and effect.

Section 17 – Termination

These Terms remain effective until terminated by you or us. You may terminate by ceasing use of the Service. We may terminate or suspend your access at any time for violation of these Terms, with or without notice.

Section 18 – Entire Agreement

These Terms, together with our Privacy Policy and any referenced policies, constitute the entire agreement between you and us and supersede all prior agreements.

Section 19 – Governing Law

These Terms and any separate agreements for Services shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts in Fulton County, Georgia.

Section 20 – Changes to Terms of Service

We may revise these Terms at our sole discretion by updating this page. It is your responsibility to review periodically. Your continued use after changes constitutes acceptance of the new Terms.
